Man Faces DUI Charges after Causing Fatal Collision

According to Fox Carolina, a 30-year-old man who allegedly caused a fatal collision earlier this month is now facing felony charges for driving under the influence. State troopers claim the man was heading south on I-385 in Greenville County when he rear-ended a Saab that was traveling in the same direction.

The force of the impact pushed the Saab off the road and into a ditch. Responders took the 54-year-old driver to a local hospital, where he later died.

Police arrested the man who had been driving the vehicle that collided with the Saab and booked him into the Greenville County Detention Center. The South Carolina Highway Patrol Multi-disciplinary Accident Investigation Team is still investigating the collision.

Does Auto Insurance Cover Damages Incurred in a Drunk Driving Collision?

Serious injuries can be incredibly costly to treat, and accident victims who file a claim against the party responsible for the damages they have incurred do not actually expect the opposing party to cover the costs out of pocket. Instead, the liable motorist’s insurance company will compensate the claimant for the damages—up to the policyholder’s coverage limits.

If you heard that auto insurance providers do not cover damages stemming from drunk driving accidents, though, you may be worried about your chances of securing a settlement. Fortunately, accident victims typically have some financial protection, even if the at-fault motorist was clearly breaking the law at the time of the collision.

Every policy is different, but insurance companies generally compensate third-party claimants for bodily injury and property damage in drunk driving collisions. Insurance providers may not compensate the motorist who caused the collision, though, even if they have purchased additional comprehensive or collision coverage.

Although you typically do not have to worry about securing a settlement if the at-fault motorist has liability coverage, you may need to worry about securing enough of a settlement to cover all of the damages you incurred. In the state of South Carolina, motorists must carry at least $25,000 in bodily injury coverage per person and at least $50,000 per accident, as well as at least $25,000 in property damage.

If the damages you incurred exceed the policyholder’s coverage or there were multiple parties involved in the collision and the combined damages exceed these limits, you may need to consider other avenues of compensation to make up the difference. Fortunately, an experienced car accident lawyer can help you explore all of your options.
